These Terms of Service ("Agreement") govern all photography services provided by Odin Glynn Photography ("Photographer," "we," "our," or "us") to the client ("Client," "you," or "your"). By booking a session, you agree to the terms outlined below.

Business Name: Odin Glynn Photography (subject to change to SportPix).

Business Structure: Sole Trader.

Registered Location: Ballinrobe, Mayo, Ireland.

Confirmation: A booking is confirmed once the full pre-payment has been made, unless otherwise agreed by the Photographer.

Payment Methods: Payments are processed via Stripe.

Late Fees: A one-day grace period applies for late payments. After that, a €5 daily fee is charged for the first 5 days, and €10 per day thereafter.

Refunds:

Weather: If weather conditions impact the shoot, Clients can either reschedule or receive a 50% refund.

Equipment Failure: If a session cannot be completed due to equipment failure, a full refund (excluding travel costs) will be provided.

The Photographer retains full ownership of all images.

Clients receive a non-exclusive, non-transferable editorial license for personal and editorial use only.

Commercial use is strictly prohibited unless an additional commercial license is purchased. Commercial enquiries to be sent to commercial@odinglynn.com

Portfolio Use: The Photographer reserves the right to use all paid images for portfolio and promotional purposes.

For paid shoots, the Photographer will seek Client consent before submitting images to Getty Images or Alamy.

For unpaid shoots, the Photographer reserves the right to submit images without Client approval.

Images will be delivered within 3 to 9 hours (in some cases, up to 1 week).

Storage: Images are retained indefinitely, however after 3 months the un-watermarked images will be archived and won't be available to the client anymore. Although, watermarked versions may remain on our website for portfolio use.

By booking, Clients grant GDPR exemption for 90 days for processing and delivery purposes.

The Photographer may permanently archive images on a secure HDD.

Clients may request image removal after 90 days by contacting contact@odinglynn.com.

Cancellations 48+ hours in advance: Full refund.

Cancellations 24-48 hours in advance: 50% refund.

Same-day cancellations are non-refundable.

Rescheduling is free if requested at least 24 hours before the shoot.

The Photographer will not share the Client's private information except where required by law.

The Photographer is not liable for cancellations or failures caused by natural disasters, pandemics, government restrictions, or other unforeseen events.

In such cases, a refund or reschedule may be offered at the Photographer’s discretion.

All images remain copyrighted by the Photographer.

Unpaid images will contain a watermark, unless both parties have come to an agreement.

Unwatermarked, high-resolution images will only be provided once full payment is received.

The Photographer retains full creative control over image edits.

Clients requesting additional edits beyond standard retouching will be charged €15 per image.

Shoots beyond 30km from Ballinrobe, Mayo may incur travel fees.

Additional time beyond the agreed shoot duration will be charged at €50 per hour.

Expedited editing (delivery under 3 hours) may be subject to a €50 rush fee.

The Photographer is not liable for equipment failures, weather conditions, or venue access issues.

The Photographer is not responsible for injuries sustained by Clients or third parties.

The Photographer is not liable for requested modifications that are unachievable due to environment limitations.

The Client grants the Photographer the irrevocable and unrestricted right to use images for marketing, portfolio display, and editorial purposes.

Clients waive the right to approve final images and understand no compensation will be provided for promotional use.

If the Client does not agree, they must notify the Photographer in writing before the shoot.

The Client agrees to indemnify and hold harmless the Photographer from any legal claims, damages, or disputes arising from the shoot.

These Terms are governed by Irish law.

Disputes must go through mediation before legal action.

These Terms may be updated periodically. Clients will be notified of significant changes.

If any provision is deemed invalid, the remaining provisions shall remain in effect.
